More safety and quality of transport, ecological transformation of air, sea and land transport, upgrading of infrastructures and safety in water, efficiency of the national port system, revisions of the traffic law to increase safety and speed up administrative procedures, innovative urban renewal interventions with special attention to minors, simplification of administration and improvement of services to citizens thanks to the digitization of practices in motor vehicles. These are the main objectives of the new law on infrastructure investments and sustainable mobility systems, which was finally approved by the Chamber of Deputies today.
“With the enactment into law of the “Mims Decree”, the second launched in just over ten months, the major set of reforms approved in the last 18 months aimed at achieving a systemic and integrated transformation of infrastructures and transport systems, ii in line with the European policies of the Green Deal and the Ministry’s commitment to sustainability and the reduction of inequalities “, declares with satisfaction the Minister of Infrastructure and Sustainable Mobility, Enrico Giovannini. “Parliament has given due value to the intense work that has seen us engaged in these months of government, with amendments that have improved our provisions. The law is only the starting point of a path that will lead Italy towards a model of sustainable development”.
More safety and transport quality – The Act allows for several measures in this area, including strengthening the control of maintenance work on local public transport (LPT) services at fixed installations, such as subways, and on regional rail services. New criteria are then established for the use of the national LPT fund: 4.9 billion euros are distributed on the basis of the criteria used so far (“historical costs”), 75 million are distributed according to innovative criteria (standard costs and appropriate levels). of local and regional public transport services) and 15 million are dedicated to experimenting with new sustainable mobility solutions in urban areas.
Among other things, the termination of the convention on the management of the A24/A25 motorways (as already provided for in Legislative Decree 85/2022) is contemplated due to a serious breach by the concessionaire. In order to ensure continuity of traffic under safe conditions, the management of the network is handled by ANAS Spa.
More sustainable transport – Simplification and acceleration of the procedures for the evaluation of the development plans of the airports of Rome Fiumicino, Milan Malpensa and Venice Tessera (which play a strategic role in the integrated infrastructure system) are planned to strengthen the interconnection between the rail system and air transport and to support measures to to mitigate and improve environmental sustainability. Faster times and simplified procedures are also envisaged for the EIA of the development plans for the other airports of national interest.
For the first time, national incentives are being introduced to promote the ecological transition in the yachting sector, aimed at replacing endothermic engines with electric ones, and at the same time promoting the development of energy communities on the smaller islands with energy production facilities from renewable sources. and facilities belonging to the airport operating companies in the airports of the smaller islands are included among the areas suitable for the installation of these facilities (Legislative Decree 199/2021).
To promote sustainable mobility, electric cars for use by people with disabilities will be able to circulate on cycle paths, as well as in pedestrian areas, while holders of B driving licenses may drive an alternatively powered vehicle up to 4.25 tonnes compared to the current 3.5. A legal qualification is then attributed to the charging infrastructure for electric vehicles and their location in the different areas of the roadway, depending on the type of road (in particular, the charging columns in the service areas are included in the ‘service accessories’).
In order to accelerate investments from state funds and NRP for the renewal of vehicles for local and regional public transport services, the obligation for co-financing from local authorities has been removed.
Upgrading of infrastructure – The procedures for the construction of road infrastructures are simplified, including the Rome-Latina motorway link, the security of the former 3-bis Tiberina road (it is the road that connects Terni and Ravenna) and the connection via Aurelia-Pietrasanta. To support the cruise activity and increase the receptivity of cruise ships in the Venice lagoon, additional temporary berths have been made in the ports of Chioggia, Monfalcone and Trieste. Interventions are also planned for the opening, modernisation, efficiency and maintenance of the infrastructures used by the Port Authority-Coast Guard, the Carabinieri and the Guardia di Finanza, and measures have been introduced to promote synergies within the FS group with the aim of reducing operating costs and shorten the time needed to implement infrastructural interventions.
Securing water infrastructure – To ensure the realization of the investments foreseen by other recent measures for the water sector (a total of more than 4.6 billion euros regarding already allocated or planned Mims), the safety measures, the control and the maintenance of the dams are strengthened, which allows for the use of new technologies, simplification and updating of procedural provisions (dating back to 1994), taking into account the development of the technical and environmental legislation as well as the distribution of competences in the sector, considering in an integrated way the procedures regarding the adduction works and the derivation associated with them.
Efficiency of the national port system – The discipline on taxation of the Port System Authorities (AdSP) is adapted to Community legislation. In particular, it has been established that the AdSPs are among the taxable persons in corporation tax, against whom the tax assumption is made in a unitary and independent manner. Furthermore, the authoritative collection of anchorage and port dues on unloaded and on-board goods and for the issuance of permits does not constitute the exercise of commercial activity. Each authority determines the amount of tax within the limits laid down in the MIMS decree in agreement with Mef, and allocates the same to cover the costs of maintenance and development of the common parts of the port area, which i.a. aims to defend the territory, control and protect the safety of maritime traffic and work in the port area, the general viability and maintenance of the seabed.
Revisions to the Traffic Act – In order to improve road safety, promote sustainable mobility and reduce the administrative burden for users, the following is foreseen: that pedal-assisted bicycles that are tampered with are equated with mopeds, with the consequent subjection to the obligations intended for the latter (number plate, insurance ). , license) and with the provision of specific sanctions for those who change them and those who use them; that electric bicycles (bicycles and scooters) are included in the classification of vehicles to ensure that they have a clearer legal framework; the inclusion in the law of the “permanent offense” category, which includes violations that are repeatedly ascertained “remotely” (lack of audit, lack of insurance, etc.) and for which the accumulation of sanctions is prohibited, unless the subject has been stopped or has received notification of the various violations; introduction of rules on aerodynamic devices fitted to transport vehicles to improve the safety of the driver and road users.
In order to reduce the administrative burden for users, speed up the issuance of driving licenses, professional qualifications and the certificate of professional competence, it is foreseen that: the related exams can be carried out by all Mims employees, suitably trained, and not only by those, belonging to the relevant offices; in the case of renewal of a driving license that has expired for more than five years, the holder must pass a new practical driving test aimed at establishing fitness to drive, without taking the theoretical test again; the paper coupon to be affixed to the circulation certificates will no longer be sent by post to moped owners who change residence, as is already the case for car owners, as the update is done automatically in the national vehicle archive; holders of an A1 or A2 driving license will be able to obtain release of the A2 or A driving license after a specific training course and without the need for a new practical exam; the start-up phase of the driving school activity is simplified by submitting the SCIA.
For persons who own agricultural and operational machinery, it is foreseen that: the formalities in connection with the issuance of the registration certificate, the certificate of technical suitability for circulation and the transfer of the ownership of agricultural machinery and the registration of operational machinery are carried out only in telematics; the registration business of agricultural machinery and the operation of machinery can also be carried out by firms or companies authorized by Law No. 264 of 1991.
