The place/school is given priority to applicants, of which:

  1. to Article 21 of Law 104/92 (applicants with disabilities and with a degree of disability of more than two-thirds or with disabilities registered in the first, second and third categories of Table A annexed to Law No. 648/1950);
  2. Article 33, subsection 6, of Act 104/92 (teachers with severe disabilities);
  3. Section 33, subsection 5 and 7, of Law No. 104/92 (applicants who help people with severe disabilities: child; legal protection; brother/sister, if the parents of the severely disabled person have disappeared or are totally disabled; spouse; parent).

Precedencewe always read in the aforementioned operating instructions, it is recognized under the conditions laid down in the current supplementary national contract on the mobility of permanent staff (CCNI 2022/25). Conditions

Pursuant to Article 13, paragraph 1, in the aforementioned CCNI 2022/25:

  • disabled staff, according to art. 21 and art. 33/6 in Act 104/92, benefits from preferential rights within and for the province where the municipality of residence is located
  • staff helping people with severe disabilities (son or brother/sister; legal protection; spouse, parent) benefits from preferential rights within and for the province, including the municipality where the disabled person resides

Whereas priorities recognized under the above conditions, the same (priority) can be usedas part of the office’s placement tasks, only to candidates affiliated in the province where it is located same aspirant’s municipality of residence with a disability (in the case of a teacher with a personal disability) or municipality of residence/residence of the child, brother/sister, spouse, parent (legal protection) with a serious disability (in case of assistance).   • the teacher with disabilities assigned in the province of residence will be able to get a seat in the municipality where he resides or in a neighboring municipality (in case of absence of a place in the municipality of residence or of another teacher with “higher” priority);
  • the teacher who assists one of the subjects listed above with severe functional impairments, who is assigned in the area of ​​residence/domicile of the assisted person, will be able to get a seat in the municipality in which he/she resides, or the assisted person. is resident or in a neighboring neighborhood (in case of absence place in the municipality of residence / residence of the assisted or another teacher with “higher” priority);
  • the teacher with disabilities assigned to a province other than the province of residence will not be able to exercise priority as they will only have to choose the seats in the assigned province; similarly, the teacher assisting a severely disabled person who is attached to a province other than the one where the assisted person resides/domicile will not be able to exercise precedence as he will only have to choose posts in the assigned province.

In the case of GaE teachers, if the province of inclusion, which will also be the location in the role, coincides with the residence of the aspirants themselves with disabilities or with the residence/domicile of the severely disabled patient, then will be able to exercise precedence, vice versa they not be able to do it.
