How do reserved parking spaces work?

The new rules on parking of electric cars: how parking spaces reserved for electric cars work after the amendments to the Traffic Act

Our highway code already provided for the existence of stalls reserved electric cars recharging, with a ban on occupying them illegally. And now with mini-reform in November last year (the Transformation Act of the Infrastructure and Transport Decree 2021), the possibility was introduced that the municipalities can reserve parking spaces for all electric cars as such, therefore also without the presence of charging points. Between saying and doing, however, the sea is involved and the activation of these new parking spaces for electric cars does not appear so immediately, so let’s take stock of the situation.

As a result of the recent amendments to the Traffic Act, the rules regarding parking of electric cars (and electric vehicles in general) currently in force are the following:

1, letter d) no. 4) stipulates that the municipalities in built-up areas may reserve limited places for parking of electric cars, permanently or temporarily or only for certain periods, days and times. PCS. 2 clarifies that these seats are intended as reserved from 8 a.m. to 8 p.m.unless otherwise stated.

Article 158 (2) Paragraphs 1 (h) to (b) and (h)

Therefore, both are prohibited in the spaces reserved for electric vehicles, both charging and not stopped, stopping from 8 to 20 (stop is a temporary and very short-term suspension of the journey, eg to allow passengers to get on or off; stop is when the car is parked indefinitely). Moreover prohibition of stopping and parking in charging stalls also applies to electric cars, which they do not need to be refilled or which occupies the parking space for over an hour after completing it (but not from 23:00 to 07:00, provided the charging point does not have a high power: in this case, the ban is valid for 24 hours).

There sanction for those who occupy the spaces reserved for parking electric cars, even if they are not right, it is from 41 to 168 euros if the violation is committed with mopeds and motor vehicles two-wheeled; And from 87 to 344 euros with passenger cars and the remaining vehicles. The sanction is applied to each calendar day on which the infringement continues and may also include the forcible removal of the vehicle.

Important: rules on electric carsincluding stop, relates to both full-electric (BEV), at plug-in hybrids (PHEV), i.e. those that require external battery charging.

Now that we know more or less all about the legislation that regulates parking spaces reserved for electric cars, the question arises: how do they recognize each other? There is one specific signs for stalls in electric cars? The answer is currently NO. In recent years, in fact, to indicate the presence of parking spaces for charging has been used ‘unofficial’ signals of various kindsboth horizontally and vertically, which lack precise provisions in the rules of the Traffic Act.

It must be an absence of uniformity healed as soon as possibleespecially since the law of November 2021, as we have seen, provides for the possibility of establishing generic drugs stalls reserved for electric carseven if they do not charge, actually compare them with other categories that benefit from reserved parking spaces, such as police vehicles or vehicles serving the disabled. And just as the stalls in these categories are marked with their own road sign, even the parking spaces reserved for electric cars must have one. But to do this, you need to have your fingers in the rules of CdS, which they have not yet done at the moment. And that may be why the new parking bays for electric cars (which are not recharged) are still nowhere to be foundeven in big cities.
